Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Insight Planning client portal (the “Portal”) operated by Insight Planning Wealth Management (“Insight Planning,” “we,” “our,” or “us”). By logging in or using the Portal, you agree to be bound by these Terms. If you do not agree, do not access or use the Portal.
1. Access and Account Security
Access to the Portal is provided exclusively to registered clients, staff, and authorized professionals of Insight Planning. Your login credentials are personal and confidential. You are responsible for all activity that occurs under your account. You must notify Insight Planning immediately at info@insightplanning.com if you suspect unauthorized access to your account.
You agree not to share your login credentials with any third party. Multi-factor authentication may be required and is offered for your protection.
2. Acceptable Use
You agree to use the Portal only for lawful purposes and in accordance with these Terms. You must not:
- Use the Portal in any way that violates applicable Canadian federal or provincial law or regulation;
- Attempt to gain unauthorized access to any portion of the Portal or its related systems;
- Transmit any unsolicited or unauthorized advertising or promotional material;
- Upload or transmit any material that contains viruses, malware, or any other harmful code;
- Use automated tools to scrape, crawl, or extract data from the Portal;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
3. Financial Information Disclaimer
The Portal provides tools and information for financial planning purposes. The content, calculators, and documents available through the Portal are for informational purposes only and do not constitute financial, legal, or tax advice. Results from planning tools are illustrative and based on assumptions you provide — they are not guarantees of future performance or outcomes.
You should consult with a qualified financial advisor, tax professional, or legal counsel before making financial decisions. Insight Planning advisors are available to review your specific situation.
4. Intellectual Property
All content, features, functionality, and design elements of the Portal — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Insight Planning Wealth Management or its licensors and are protected by applicable Canadian copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Portal solely for your personal financial management purposes. You may not reproduce, distribute, modify, or create derivative works of any Portal content without express written permission from Insight Planning.
5. Electronic Communications and Documents
By using the Portal, you consent to receive communications, notices, and documents from Insight Planning electronically through the Portal and by email. This includes account statements, client updates, reports, and other information that we may be required or permitted to provide to you. Electronic delivery satisfies any legal requirement that such communications be provided in writing.
You may withdraw your consent to electronic delivery at any time by contacting us at info@insightplanning.com. Withdrawal of consent may affect your ability to use certain features of the Portal.
6. Privacy
Your use of the Portal is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Portal, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Insight Planning, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Portal, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or your use of the Portal shall not exceed the amount paid by you to Insight Planning in the twelve months preceding the event giving rise to the claim.
The Portal is provided “as is” and “as available.” We do not warrant that the Portal will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Account Termination
Insight Planning reserves the right to suspend or terminate your access to the Portal at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, termination of your advisory relationship with Insight Planning, or inactivity.
Upon termination, your right to use the Portal ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on the Portal or sending an email to your registered address. Your continued use of the Portal after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kelowna, British Columbia.
